1.    TERMS

All goods are sold loaded ex works carriage extra.  The purchaser being responsible for off loading and installation.

 

a).   NEW MACHINES TOOLS & EQUIPMENT

All prices invoiced will be those ruling at date of despatch.  Payment strictly in 30 days from invoice.  New machines are covered by manufacturers guarantee.

 

b).    USED MACHINE TOOLS

Payment strictly against invoice but in any case prior to arrangements for delivery unless otherwise agreed by us in writing.

 

c).    MACHINES SOLD AS SEEN OR AT REDUCED RATE

        Machines not guaranteed for performance or specification and must be accepted as seen and inspected.

 

d).    MACHINES SOLD CHECKED OVER & REPAIRED AS NECESSARY

Machines are covered by our guarantee that if machines are mechanically unsatisfactory they may be returned pre-paid to our works within 14 days of invoice whereupon we will refund the purchase price in full.  Also the guarantee covers all faulty mechanical parts that they will be replaced free of charge, fitting charged extra, for up to 30 days from invoice date.

 

e).    MACHINES SOLD BY WAY OF THIRD PARTY

Used machines purchased & sold by us from a third party on behalf of our client carry no warranty whatsoever and must be accepted as is, as seen and inspected ex site.

 

f).     EQUIPMENT 

Machines supplied with no extra equipment in excess of that with machine at time of inspection.  Certain new standard equipment can be supplied on request.

 

2.      TITLE

 In the event of the buyer going into liquidation, bankruptcy or for any reason whatever is unable to pay in full and final 

 settlement we reserve the right to reclaim the goods supplied.  Ownership of the goods shall in no circumstances pass to the

 purchaser until payment is actually made and without  prejudice to the generality of the foregoing. This shall apply

 notwithstanding the fact that the goods may be in the purchaser’s possession.

 

3.     DELIVERY

        Time for delivery is estimated as accurately as possible, but it is subject to any delays or breakdown beyond the control of the seller and is not guaranteed.  Provisions for penalties for delay in delivery or otherwise are excluded from any contract based on this quotation.  We are not to be held liable for any losses or damage whatsoever arising from late delivery or failure of manufacturers to proceed with manufacturer.

 

SPECIFICATIONS

Manufacturers’ or suppliers’ illustrations and specifications supplied by us are not binding.  The right is reserved to vary or modify specifications provided the design of the machine is not substantially altered.

 

DAMAGE, SHORTAGE OR LOSS

The seller does not accept responsibility for any damage, shortage or loss in transit unless:-

Damage or shortage is notified in writing both to the seller and to the carriers within seven days of receipt of goods and the

     goods have been signed for as ‘not examined’ and have been handled by the buyer in accordance with carriers conditions or

b) Non-delivery (in the case of total loss) is notified both to the seller and to the carriers within 10 days of the date of despatch.

 

HEALTH & SAFETY AT WORK ACT 1974

The sale of items listed is made on the condition that they will not be put into use at work if and so far as they do not comply with the Health & Safety at Work Act 1974.  Under that act you have a responsibility to ensure compliance with the Act before such items are put into use at work.

This used machine(s) are bought as seen and may not be fully guarded (as discussed). The equipment should not be brought into use until fully guarded and with out risk to Health & Safety as detailed in the Health & safety At Work Act 1974 and the Provision of Work equipment regulations 1998.

         Advice from a guarding company can be obtained on your behalf if required.

 

DESCRIPTIONS

Every attempt is made to detail specifications correctly but nothing in the particulars should be deemed to form part of any contract for the sale of machine or equipment.

 

CANCELLATION

Orders cannot be cancelled except with our consent.  We reserve the right to charge cancellation fees if we accept cancellation.

 

COMPLAINTS

If no complaint is made within 14 days of delivery, in writing, the goods will be deemed to be supplied in accordance with the contract, and the customer shall be bound to pay for the same.

 

10.    These conditions cancel any other conditions to the contrary and are in addition to those expressed or implied whether by 

          agreement, common law or statute.

 

11.    The construction and validity of these conditions shall be covered by the Law of England.
